OFFICIAL RULES

WHO CAN ENTER
1.Entrants must be legal Ohio residents who are 21 years of age or older, have a valid Ohio Driver’s License, proof of Auto Insurance, and have lawful access to the Internet and a valid e-mail address.

2.Employees of LocalTV, LLC, on behalf of its station WJW (TV) FOX 8, Bill Doraty Kia (collectively, “Sponsors”), and their affiliated companies, and the advertising and promotion agencies of each and the immediate family members of each are ineligible.

HOW TO ENTER AND HOW TO WIN
1.No purchase is necessary to enter or win. One entry per email address.

2.The sweepstakes begins at 12:01 AM local time on September 8, 2009, and all entries must be received by 11:59 PM local time on September 27, 2009.

3.To enter, create a lawn sign that says “I want to win the Bill Doraty KIA Soul Sweepstakes and I watch FOX 8 News at 9am!” The sign may be any size, and include any decorations you see fit. The sign must be placed in your front lawn during the contest window (9/8/09 – 9/27/09). Take a picture of your completed lawn sign and then complete the following entry steps:

a.Log onto fox8.com, rollover the “Find Us” tab, click on the “Contests” link, and then click on the “Bill Doraty Kia Soul Sweepstakes” logo. Here you will register by providing your name, address, phone number, gender, age, and email address, plus you must upload the picture you took of your lawn sign described in item #3 above.

4.All signs must remain in each registrant’s front lawn for the duration of the contest. Failure to do so will disqualify the registrant from winning the grand prize.

5.One (1) Grand Prize Winner will be selected by random drawing from among valid entries on or about September 28, 2009. The Grand Prize Winner must be at home, available, and have their sign still intact in their front lawn on Tuesday, September 29th, 2009, to be awarded their prize.

The Grand Prize Winner must agree to the Bill Doraty Kia Soul lease agreement and abide by the rules and regulations it sets forth. If a winner does not agree to the terms of the lease agreement, the Grand Prize Winner forfeits their prize and an alternate winner will be chosen at random.

6.LIMITATION OF LIABILITY & OTHER CONDITIONS: The Sponsor reserves the right, in its sole discretion, to cancel, terminate, modify or suspend this Contest or any portion hereof, or to disqualify any individual implicated in any of the following actions, if for any reason: (a) infection by computer virus, bugs, interruption in wireless calling devices or wireless service, tampering, unauthorized intervention, actions by entrants, fraud, technical failures, or any other causes which, in the Sponsor's sole opinion, corrupt or affect the administration, security, fairness, integrity or proper conduct of the Contest, (b) the Contest or any website associated therewith (or any portion thereof) becomes corrupted or does not allow the proper processing of entries per these Official Rules, (c) the Contest becomes corrupted due to wireless calling service interruption for any reason, or (d) the Contest is otherwise not capable of running as planned. By entering, entrants represent that they are eligible and agree to be bound by and comply with the Official Rules and the decisions of the judges. Entrants further agree to release, hold harmless and indemnify the Sponsor and each of their parent, subsidiary companies, affiliates, divisions, franchisees, representatives, consultants, subcontractors, suppliers, distributors, legal counsel, advertising, public relations, promotional, fulfillment and marketing agencies, and their officers, directors, employees, shareholders and agents (collectively the "Released Parties"), from and against any and all claims, actions and/or liability for any injuries or death, loss or damage of any kind arising from or in connection with participation in and/or entry into the Contest or acceptance, delivery or use of any prize. The Released Parties are not responsible or liable for any incorrect or inaccurate entry information or other errors in the printing, offering or administration of the giveaway or in the announcement of the prize(s) and assume no responsibility for (i) any error, omission, interruption, defect or delay in operation or transmission at any website, or wireless calling service, interrupted or unavailable network, server or other conditions, (ii) failure of any entry to be received by the Sponsor due to technical problems, telephone service problems, human error, or wireless calling service, (iii) communication line, hardware and/or software failures, malfunction of phones (including wireless phones/handsets), phone lines, other communications malfunctions, unavailable network connections, cellular equipment towers, telephone systems or wireless service, (iv) damage to any computer (software or hardware) resulting from participation in the Contest, or damage to mobile phone or other PDA device, (v) theft or destruction of, tampering with, unauthorized access to, or alteration of entries and/or entry information, or (vi) entries which are late, lost, stolen, damaged, illegible, and/or unintelligible (or any combination thereof). Any entrant who attempts to tamper with this Contest in any way shall be disqualified. WJW reserves the right to disqualify any entrant at any time, for any reason, including, without limitation, language, activities or behavior deemed inappropriate. By participating, entrants agree that the foregoing parties have neither made nor are in any manner responsible or liable for any warranty, representation or guaranty, expressed or implied, in fact or in law, relating to any prize. The Sponsor and their advertising and promotion agencies are not responsible for cancellations, postponements, or delays. WJW shall have the sole discretion to administer the Competition and interpret and apply the Official Rules. Any expenses incurred by the entrant during the application process, including but not limited to, postage are the sole responsibility of each applicant and the Sponsor will not issue reimbursement for any expenses.

7.ARBITRATION/CHOICE OF LAW: Except where prohibited, entrants agree that any and all disputes, claims and causes of action arising out of or connected with this Contest shall be resolved exclusively by arbitration pursuant of the Rules of the American Arbitration Association then effective. The Sponsor shall not be responsible for any attorneys’ fees, punitive, incidental, consequential or other damages. All issues and questions concerning the construction, validity, interpretation and enforceability of these Official Rules, or the rights and obligations of entrants and the Sponsor in connection with the Contest shall be governed by and construed in accordance with the laws of the State of Ohio, without giving effect to any choice of law or conflict of law rules or provisions (whether of Ohio or any other jurisdiction) that would cause the application of the laws of any jurisdiction other than Ohio. The invalidity or unenforceability of any provision of these Official Rules remains in effect. In the event that any such provision is determined to be invalid or otherwise unenforceable, these Official Rules shall be construed in accordance with their terms as if the invalid or unenforceable provision was not contained therein.

THE PRIZES
1.ONE (1) GRAND PRIZE WINNER will receive a three (3) year lease on a Kia Soul [E.R.V.: $9,324; provided by Bill Doraty Kia].

2.Except where prohibited by law, entry constitutes permission to use winner’s name, hometown, likeness, and photograph for online posting, and/or any advertising and publicity without additional compensation.

3.The Grand Prize Winner will be notified by phone on or about September 28, 2009. The Grand Prize Winner will be required to complete, sign and return a Certificate of Eligibility and Release within five (5) days of the date of notification or they will be disqualified. If the winner cannot be reached, or if the winner does not complete, sign and return the Certificate of Eligibility and Release within the designated time period, the prize will be awarded to an alternate winner selected by random drawing. If the alternate cannot be reached, or if the alternate does not complete, sign and return the Certificate of Eligibility and Release within the designated time period, the prize will not be awarded.

4.Prize cannot be redeemed for cash or substituted for any other items by the winner. The winner cannot assign or transfer prize. Sponsors reserve the right to substitute a comparable prize of like or greater value, including cash, for any prize, for any reason.

5.Winner is responsible for all local, county, state, and federal taxes based on the estimated retail value of the prize as stated in the rules. Only one prize will be awarded.

ODDS OF WINNING: MISC
1.Odds of winning depend on the number of entries received. Complete contest rules are available through October 30, 2009 Monday through Friday during normal business hours at WJW (TV) FOX 8, 5800 South Marginal Road, Cleveland, Ohio or on fox8.com through September 27, 2009.

2.For the Grand Prize Winner’s name, send a self-addressed, stamped envelope after October 2nd, 2009 and before October 30, 2009 to “Bill Doraty Kia Soul Sweepstakes”, c/o WJW (TV) FOX 8, 5800 South Marginal Road, Cleveland, Ohio, 44103.

3.This giveaway is subject to all applicable laws and regulations and is void where prohibited or restricted by law, including without limitation, in jurisdictions requiring registration, filing, trust account, or posting of a bond, or any other requirements or disclosures that are not expressly satisfied by these rules. Sponsors are not responsible for typographical or other errors in the printing, offering, or administration of the giveaway, or in the announcement of the prize.

4.By entering, participants represent that they are eligible, and agree (a) to be bound by these rules and the decisions of the judges, (b) to release Sponsors, their parent companies, subsidiaries, affiliates, directors, officers, employees, and agents from any and all liability for any injuries, losses, or damages of any kind caused by any prize or resulting from acceptance, possession, use, or misuse of any prize, (c) to Sponsors’ use of entrants’ personal information as described in WJW (TV) FOX 8’s Privacy Policy located at fox8.com, and (d) entry constitutes an assignment to sponsors of all intellectual property rights in the entry materials, if any.
